Chip Ganassi Racing leads Rolex 24 at Daytona (AP)

DAYTONA BEACH, Fla. ? Chip Ganassi Racing was back out front of the Rolex 24 at Daytona, with the defending race winners clinging to the lead Sunday morning in the twice-around-the-clock endurance race.

Joey Hand put the No. 01 BMW Riley out front when Michael Shank Racing had an extended pit stop with about six hours remaining. IndyCar driver Justin Wilson had opened up a nearly full lap lead over the Ganassi team during a triple driving stint, but MSR appeared to change its brakes when Wilson came in for the driver change.

Hand then moved out front before he was replaced by defending Grand-Am champion Scott Pruett. The team is made up of Grand-Am champions Pruett and Memo Rojas, Hand and IndyCar driver Graham Rahal.

The team won last year's race, but appears to be at a horsepower disadvantage this season to the Fords and Chevrolets. MSR's No. 60 is a Ford Riley.

"We're definitely pushing for sure. We don't have quite the straightline speed that those other guys have," Hand said. "But we still have a shot at this thing."

The second Ganassi entry was four laps off the pace with NASCAR driver Juan Pablo Montoya behind the wheel. The car was strong during the night but went six laps down when the shifter broke while IndyCar's Scott Dixon was driving.

That entry is somewhat of the "star car" with NASCAR drivers Montoya and Jamie McMurray, and IndyCar champions Dixon and Dario Franchitti. That group finished second to its Ganassi teammates last season.

Only two Daytona Prototypes were on the lead lap, and the championship-contending SunTrust Racing was knocked out of the race during the first hour on Saturday.

Max Angelelli took the No. 10 Chevrolet to the garage with an engine issue 25 minutes into the race. The team sent the car back out after a few minutes, but moments later Angelelli was back in the garage for good in the 50th running of the prestigious sports car event.

"We've never had an engine problem in all the time we've run the Chevrolet engine program, so this is the first time," team owner Wayne Taylor said. "There was truly nothing we were worried about. In fact, this is probably the one 24 Hour I think we all felt ? the only thing we were worried about was traffic, and we didn't have any issues. Really caught us by surprise."

The engines are made by NASCAR's Earnhardt Childress Racing organization. Taylor said the problem was in the valve train, and was "catastrophic."

Angelelli and Wayne Taylor won the Grand-Am championship in 2005, and have finished second in the standings the last two seasons to Pruett and Rojas. The SunTrust team also won the 24-hour race in 2005.

X-Games star Travis Pastrana made his debut in this race with the AF Waltrip team. He's driving with Michael Waltrip Racing owners Waltrip and Rob Kauffman, and Rui Aguas in a Ferrari in the Grand Touring class.

He called driving the Ferrari something that should be on everyone's "bucket list" and said he was thrilled to have been added to the team last month.

"Most of the experience that I have is actually in the four-wheel-drive cars," said Pastrana, who will race a limited schedule for Waltrip this season in the second-tier Nationwide Series.

"So getting the opportunity to come out here in rear-wheel-drive car I think is very helpful, especially for when NASCAR hits the road courses."

How the major stock indexes fared on Tuesday (AP)

The Dow Jones industrial average and S&P 500 index both ended lower Tuesday on concerns that a deal to cut Greece's national debt and stave off a financial crisis might fall through. A number of lower-than-expected corporate earnings also sent the major indexes down. The Nasdaq composite finished slightly higher after wavering all day.

The Dow Jones industrial average fell 33.07 points, or 0.3 percent, to 12,678.75.

The Standard & Poor's 500 index lost 1.35 points, or 0.1 percent, to 1,314.65.

The Nasdaq composite index rose 2.47 points, or 0.09 percent, to 2,786.64.

For the week:

The Dow is down 44.73, or 0.4 percent.

The S&P 500 is down 0.73 points, or 0.06 percent.

The Nasdaq is down 0.06 points, or less than 0.01 percent.

For the year to date:

The Dow is up 458.19, or 3.8 percent.

The S&P 500 is up 57.05 points, or 4.5 percent.

The Nasdaq is up 181.49 points, or 7 percent.

Google Music updated in Android Market, fixes bugs in shuffling songs and multiple accounts

Google Music

Google Music has been updated to version 4.1.512, bringing fixes to shuffle mode and fixes for folks using multiple Google accounts.  The update looks to be across the board for all devices running Android 2.2 or higher, so be sure to check and see if your copy is up-to-date.  We love Google Music around here, and on devices without removable storage it's a life saver.  Hit the break for the download link if you haven't given it a try yet.

Supreme Court rules police need warrant for GPS tracking (Reuters)

WASHINGTON (Reuters) ? The Supreme Court ruled on Monday that police cannot put a GPS device on a suspect's car to track his movements without a warrant, a test case that upholds basic privacy rights in the face of new surveillance technology.

The high court ruling was a defeat for the Obama administration, which had argued that a warrant was not required to use global positioning system devices to monitor a vehicle on public streets.

The justices unanimously upheld a precedent-setting ruling by a U.S. appeals court that the police must first obtain a warrant to use a GPS device for an extended period of time to covertly follow a suspect.

The high court ruled that placement of a device on a vehicle and using it to monitor the vehicle's movements was covered by U.S. constitutional protections against unreasonable searches and seizures of evidence.

There are no precise statistics on how often police in the United States use GPS tracking in criminal investigations. But the Obama administration told the court last year it was used sparingly by federal law enforcement officials.

The American Civil Liberties Union rights group hailed the ruling as an important victory for privacy. "While this case turned on the fact that the government physically placed a GPS device on the defendant's car, the implications are much broader," Steven Shapiro of the ACLU said.

"A majority of the court acknowledged that advancing technology, like cell phone tracking, gives the government unprecedented ability to collect, store, and analyze an enormous amount of information about our private lives," he said.

SUSPECTED DRUG TRAFFICKER

The case began in 2005 when police officers went to a public parking lot in Maryland and secretly installed a GPS device on a Jeep Grand Cherokee used by a Washington, D.C. nightclub owner, Antoine Jones.

Jones was suspected of drug trafficking and the police tracked his movements for a month. The resulting evidence played a key role in his conviction for conspiring to distribute cocaine.

The appeals court had thrown out Jones's conviction and his

life-in-prison sentence, and ruled prolonged electronic monitoring of the vehicle amounted to a search.

All nine justices agreed in upholding the appeals court decision, but at least four justices would have gone even further in finding fault not only with the attachment of the device, but also with the lengthy monitoring.

In summarizing the court's majority opinion from the bench, Justice Antonin Scalia said attachment of the device by the police was a trespass and an improper intrusion of the kind that would have been considered a search when the Constitution was adopted some 220 years ago.

The administration argued that even if it were a search, it was lawful and reasonable under the Constitution. Scalia said his opinion did not decide that issue and some more difficult problems that may emerge in a future case, such as a six-month monitoring of a suspected terrorist.

Joining Scalia's opinion were Chief Justice John Roberts and Justices Anthony Kennedy, Clarence Thomas and Sonia Sotomayor.

Sotomayor wrote separately to say the case raised difficult questions about individual privacy expectations in a digital age, but said the case could be decided on narrower grounds over the physical intrusion in attaching the device.

LONG-TERM MONITORING

Justice Samuel Alito wrote a separate opinion that Justices Ruth Bader Ginsburg, Stephen Breyer and Elena Kagan joined. He wrote that he would have decided the case by holding that Jones's reasonable privacy expectations were violated by long-term monitoring of his vehicle's movements.

Alito said in recent years many new devices have emerged that track a person's movements, including video surveillance in some cities, automatic toll collection systems on roads, devices on cars that disclose their location, cell phones and other wireless devices.

"The availability and use of these and other new devices will continue to shape the average person's expectations about the privacy of his or her daily movements," he wrote.

One law professor said those four justices were clearly concerned about the potential impact of new technologies and believed extended monitoring likely required a warrant so law enforcement should "be on the safe side and get a warrant."

"This is an indication that there are justices who are recognizing that privacy norms are shifting but the fact that people's lives take place increasingly online does not mean that society has decided that there's no such thing as privacy anymore," said Joel Reidenberg, a law professor at Fordham University in New York.

The Supreme Court case is United States v. Antoine Jones, No. 10-1259.

Madagascar exiled president sent back to S.Africa (AP)

JOHANNESBURG ? Madagascar's toppled president tried to end his exile in South Africa Saturday, but his commercial plane was forced to turn back mid-flight when his landing was blocked by the populist former disc jockey who toppled him.

Ex-President Marc Ravalomanana's Indian Ocean island has a long history of volatile politics, and the air standoff shows how personal rivalry can stand in the way of stability.

Ravalomanana has been exiled in South Africa since being toppled in 2009. When he tried to return last year, he was stopped at the Johannesburg airport after aviation authorities in Madagascar wrote to say he was not welcome.

Thousands of Ravalomanana supporters awaited his return at the capital's airport Saturday. But a government minister told reporters there that the politician who toppled him with military backing, Andry Rajoelina, had issued a notice closing the country's main airports to prevent the former leader's return.

Ravalomanana supporters slowly left the airport. Security forces fired tear gas to force the last of the crowds to retreat.

A frustrated Ravalomanana at first refused to leave the plane after it landed back in Johannesburg. After more than two hours, he agreed to be escorted to a hotel in Pretoria by South African government officials.

Hours earlier Ravalomanana, his wife, two aides, journalists and passengers not linked to him had boarded a commercial flight. Ravalomanana said he wanted to return to Madagascar to work for peace and democracy in his troubled homeland. He has already accepted a transitional government headed by Rajoelina that is supposed to oversee elections next year.

Friday, Ravalomanana had told reporters in Johannesburg that if he were to regain power in that vote, he would put into practice what he said he had learned during exile in South Africa about respecting the rule of law and freedom of expression.

South Africa saw brutal white minority rule peacefully toppled in 1994 and multiracial democracy installed through negotiations and power-sharing. Madagascar has little history of such constructive politics on which to draw.

A central figure in Madagascar's politics, Didier Ratsiraka, took over from military rulers in 1975 and led the country for 16 years, presiding over a socialist and highly centralized state and clamping down on the opposition. Ratsiraka lost key support because of a deadly confrontation between troops and demonstrators in 1991, and was defeated in elections the next year.

Ratsiraka emerged again to win in 1997. The next election in 2001 pitted him against Ravalomanana. The results were disputed and low-level fighting split the country between two governments, two capitals and two presidents before Ratsiraka fled to France in 2002.

Ratsiraka, who some believe backed Rajoelina's rise to exact revenge on Ravalomanana, returned to Madagascar in November after nearly a decade in exile.

Late Friday, South Africa's deputy foreign minister Marius Fransman, who has led regional efforts to restore democracy in Madagascar, issued a carefully worded statement noting "contextual challenges relating to the political situation in Madagascar." Then he called "on all the political formulations and the political leadership, in particular ... Mr. Andry Rajoelina and former President Mr. Marc Ravalomanana to exercise political maturity."

Members of the unity government under Rajoelina have been bickering over how positions have been filled. Saturday's events were likely to put further strain on the arrangement. They drew condemnation from Mamy Rakotoarivelo, a member of Ravalomanana's party who under the unity agreement is president of the transitional parliament.

"Andry Rajoelina still thinks he's solely in charge of the government," Rakotoarivelo told reporters in Madagascar. "It's unacceptable."

For months before the coup, Rajoelina led rallies against Ravalomanana, whom he accused of being out of touch with the sufferings of the country's impoverished majority.

Ravalomanana's government at one point blocked the signal of a radio station Rajoelina owned. In response, Rajoelina supporters set fire to a building in the government broadcasting complex as well as an oil depot, a shopping mall and a private TV station linked to Ravalomanana. Scores of people were killed.

Days later, soldiers opened fire on anti-government protesters, killing at least 25.

Friday, Ravalomanana told reporters he had nothing to do with orders to close the radio station or fire on demonstrators.

Following Rajoelina's military-backed coup, Ravalomanana was convicted in absentia of conspiracy to commit murder in a case related to the turmoil during the overthrow that forced him to leave. Ravalomanana called the tribunal appointed by Rajoelina illegitimate.

Security officials in Madagascar had said the toppled president would be arrested if he returned.

Italian Nanni Moretti to head Cannes jury (Reuters)

PARIS (Reuters) ? Acclaimed Italian actor and director Nanni Moretti will head the jury at the 2012 Cannes film festival in May, organizers said on Friday.

The 58-year-old has had a long association with the world's most important cinema showcase, appearing in competition in 1978 with "Ecce Bombo."

He was back in 1994 with "Caro Diario" (Dear Diary), for which he won the best director award, and in 2001 with "La Stanza del figlio" (The Son's Room), which won the coveted Palme d'Or for best picture.

Five years later came "Il Caimano" (The Caiman), a film that criticized aspects of Italian political life in the era of Silvio Berlusconi.

"This is a real joy, an honor and a tremendous responsibility to preside over the jury of the most prestigious festival of cinematography in the world," said Moretti, who served on the Cannes jury in 1997.

"As a spectator, fortunately I still have the same curiosity that I had in my youth and so it is a great privilege for me to embark on this voyage into the world of contemporary international film," he added in a statement.

The 2012 festival runs from May 16-27.

Romney offshore accounts contain up to $32 million (AP)

WASHINGTON ? Republican presidential candidate Mitt Romney owns investments worth between $7 million and $32 million in offshore-based holdings, which are often used legitimately by private equity firms to attract foreign investors. Such offshore accounts also can enable wealthy investors to defer paying U.S. taxes on some assets, according to tax experts.

An Associated Press examination of Romney's financial records identified at least six funds set up in the Cayman Islands, a small Caribbean island chain that has long been used as a base for international investments because of low tax rates and financial secrecy. Romney has acknowledged that some of his investments are based in the Caymans, but he has not identified all of the specific accounts and the amounts based there. There is no indication Romney uses the accounts to dodge any U.S. tax obligations.

The Caymans have often been associated with individuals and corporations seeking to avoid paying U.S. taxes. However, it is legal for U.S. residents to own investment accounts that are set up there ? if they file the proper forms with the Internal Revenue Service and pay the appropriate taxes.

"If you file the forms and report the income, you are 100 percent legal," said Kevin Packman, a Miami lawyer who chairs the offshore tax compliance team at the law firm of Holland & Knight.

Independent tax policy experts said Romney's use of the Cayman-based investments was legal, but some criticized the strategy as a province of wealthy investors allowed by a tax code studded with loopholes.

"The bottom line is, they're taking advantage of a system that's flawed," said Nicole Tichon, director of Tax Justice Network USA, part of a global network promoting tax transparency. "It may be legal, but these are loopholes that show problems in our tax code."

The six Romney offshore holdings are in investment funds run by Bain Capital, the private equity powerhouse he led in the 1980s and 1990s. The six funds are listed only by name and a range of amounts in Romney's financial records, but the Cayman addresses are in other corporate documents filed with the U.S. Securities and Exchange Commission and in foreign investment portfolios.

Five of the Cayman-based funds are included within a blind trust for Romney's wife, Ann, and worth between $2.8 million and $7.6 million.

A sixth fund, called Bain Capital Investment Partners Trust Associates lll, is part of Romney's IRA retirement account and worth between $5 million and $25 million.

In a financial report last August, Romney declared a family fortune worth as much as $250 million. The six Cayman funds are among dozens of investments the Romneys have owned since he left Bain in 1999 to organize the 2002 Olympic Games in Salt Lake City and then pursue a career in politics.

A Romney spokeswoman, Andrea Saul, said the Cayman funds "are taxed in the very same way they would be if those funds were established in the United States." She noted that because many of the funds are in a trust directed by a Boston lawyer, the Romneys played no role in deciding how the money was invested.

Saul said the decision to set up the funds in the Caymans was made by the funds' sponsors ? in this case, senior partners at Bain Capital, not Romney. A Bain spokesman declined to comment on the funds' origins.

Tax experts and lawyers said using offshore funds to attract foreign investors is a legitimate and standard business practice. Increased foreign investment in a U.S. fund based abroad could increase financial returns for American investors. Offshore funds offer advantages for U.S. investors looking to diversify their portfolios and for foreign investors seeking to avoid U.S. reporting and tax-withholding requirements.

"If you have a foreign investor who is making income largely abroad and doesn't want to be subject to U.S. regulations and reporting, it's a plus," said C. Eugene Steuerle, co-founder of the Urban-Brookings Tax Policy Center and former deputy assistant treasury secretary for tax analysis.

Under American law, U.S. investors must pay taxes on profits made from offshore investment funds. However, U.S. investors may be able to defer those taxes until later as they bring the profits into the U.S., depending on how the fund is structured, said Kevin Packman, chairman of his firm's offshore compliance team at Holland & Knight of Miami.

Some hedge fund and private equity managers route IRA retirement holdings through an offshore entity set up as a "blocker corporation," an affiliate of a private equity fund that acts as a way-station, storing the retirement funds while investing an identical amount in the actual fund. This complicated maneuver allows the investor to defer paying a 35 percent tax on earnings that the IRS considers "unrelated business income," said Michael J. Graetz, a Columbia University law professor and an authority on national and international tax law.

The 35 percent tax is aimed at pension funds, university endowments, hospitals and other nonprofit organizations when they invest in private equity funds that borrow large amounts of money to buy other companies. But nonprofits can use the offshore blocker funds to defer those tax payments, and similarly, IRA accounts can be routed through blocker accounts, depending on how tax plans are structured, Graetz said.

"One of the major functions of tax planning is to defer payments and deal with them down the road instead of today," Graetz said. "For an IRA account, it's not so much a tax rate game as it is a timing game."

Romney's other offshore-based investments would not benefit from that structure, Graetz said. But their earnings could be boosted by blocker corporations that promote investments by nonprofits, he said.

Romney's taxpaying strategy may become clearer when he makes his 2012 tax returns available in April as he has promised.

Congress has tried to make it harder for investors to defer tax payments by broadening requirements that U.S. investors in foreign-based funds pay taxes as they earn profits. But aggressive tax planners can still find ways to get around the rules, experts said.

"You have to look at each investment and its structure before you can pass judgment," Steuerle said.

Benefits to deferring tax payments include the ability to reinvest the deferred taxes, earning higher returns before bringing the money into the U.S. A wealthy investor who has no immediate need for the money would be able to keep the investment offshore indefinitely, never paying U.S. taxes on it.

MELBOURNE, Australia ? It was early in Novak Djokovic's second-round match at the Australian Open and the world's top-ranked player was looking more like a journeyman.

Playing against Santiago Giraldo, ranked 55 places behind him, Djokovic made four straight unforced errors in the fifth game to hand the Colombian the first service break of the match. But Djokovic quickly broke Giraldo to love in the next game and went on to win the next seven on his way to a 6-3, 6-2, 6-1 victory at Melbourne Park, playing much more like the man who won three Grand Slam singles titles and 41 matches in a row last year.

"I maybe started a little too defensive because he was hitting the ball very strong," Djokovic said. "But then after, it was the other way around."

A title this month would put him in select company. Only four players ? Laver, Pete Sampras, Roger Federer and Rafael Nadal ? have won three straight Grand Slam singles tournaments, and Djokovic could join them following his wins at last year's Wimbledon and U.S. Open.

Second-seeded Nadal and third-seeded Federer, who are in the other half of the draw here, play back-to-back matches at Rod Laver Arena on Friday.

Ex-Vassar worker, wife sentenced for $2.5M theft (AP)

POUGHKEEPSIE, N.Y. ? A former Vassar College worker and his wife accused of embezzling more than $2.5 million from the New York school are headed behind bars.

Arthur Fisher and wife Jennifer were arrested in April after investigators determined money had been embezzled from Vassar, where Fisher worked as a construction project manager from 2005 through 2010. He later confessed.

Arthur Fisher was sentenced last week to four to 12 years for the thefts. Jennifer Fisher was sentenced to six months in jail and five years' probation. The Poughkeepsie Journal reports ( http://pojonews.co/x74UUC) that the Ossining couple also have to pay back the money.

A Westchester County judge on Wednesday sentenced Arthur Fisher to five years in prison on weapons charges stemming from illegal guns seized from his home. The sentences will run concurrently.

Online Debate Flares Over Columbia Pets for Purchase - Columbia ...

An outcry by animal activists over pet stores that sell animals has broken out on Columbia Patch.

The activists say selling animals is obsolete and deprives shelter animals of good homes, but pet store owners who have been targeted by activists in other parts of the country defend what they say are honest legitimate businesses.

Charm City Puppies, a purebred dog and high-end pet accessory store that opened this month off Snowden River Parkway, sparked the conversation about pet stores, puppy mills and shelter animals on an article published Dec. 9 about the then-coming business. Nearly 130 comments have been posted ? most of them since Saturday.

Animal advocates online said that reputable breeders don?t sell puppies to pet stores, and instead prefer to screen potential buyers to ensure puppies go to good homes.

Pet shops are legal businesses in Howard County and Maryland, and Charm City Puppies operates in a properly zoned retail space, Howard County officials said.

?Maryland is a pretty progressive state and full of animal lovers,? wrote one commenter, Linda Hauser. ?I'm hoping [the business] will see the light and consider not selling puppies in the future and show a willingness to work with all the rescue groups who work so diligently to find homes for dogs in their care.?

Charm City co-owner Tony Cossentino declined to be interviewed this week, citing personal safety concerns in the wake of the online criticism.

Multiple attempts to get comments from other pet store owners in the Baltimore metropolitan area for this article were unsuccessful.

Animal rights activists have focused on stores selling pets in other parts of the country as well.

In July, a pet store in Corona Del Mar, CA, came under scrutiny from animal rights activists less than a month after the store opened, according to the Newport Beach Independent.

The activists accused the store of selling a puppy from a puppy mill ? an accusation the store's owners disputed.

Co-owner Suzanne Bradford said the treatment her store received at the hands of activists "isn't right," and said she and her two business partners are "running an honest, legitimate business," according to the Independent.

Cossentino told Patch last month that he would depend only on USDA-approved breeders to stock his store.

The U.S. Department of Agriculture has policies regarding animal and plant health, said Howard County spokeswoman Alex King, and Cossentino would be required to have a special federal license if he is transporting animals across state lines.

Animal Advocates of Howard County Director Laurie Wallace said many activists are concerned about pet shops because they engage in the selling of living things.

"Getting a pet shouldn't be like going to WalMart to buy a tangible good," she said. "Pets aren't things, they are members of our family."

Patch writer Nikki Gamer visited Charm City Puppies Tuesday.

She found a small, pristine shop with seven puppies and dozens of boutique pet items for sale.

Instead of cages, the puppies were housed in pillowed cribs, and employees were dressed in nurse-like uniforms to give the appearance of a nursery, according to Gamer.

Meet-and-greet areas in the back of the store allow potential customers to interact with puppies.

Some areas of the country ban pet stores. In October, Global Animal, a news magazine about pets, wrote that shopping center developer Macerich said it would ban sales of live animals in more than 70 of its malls nationally, a move designed to ?break the puppy mill business.?

According to an editorial in the Rapid City Journal, a newspaper in Minnesota, the move also broke a local business called Fish Here Pet Center, which had sold pets in that area since 1978.

?The policy ?. may have been done for reasons that its managers believe are for a good cause ? stopping puppy mills ? but the policy is chasing away a tenant of 33 years that is not part of the problem Macerich is attempting to prevent,? according to the paper?s editorial board.

The business owners told the paper they didn?t get store animals from puppy mills?rather all came from local families, pets that would otherwise have gone to government shelters and faced euthanasia.

The Howard County Animal Shelter and Adoption Center, which must take any animal dropped off, took in 2,400 domestic animals and reptiles in 2010, according to Howard County police spokeswoman Elizabeth Schroen.

In 2010, the shelter took in 2,162 living dogs and cats. Of those, 1,074, or about 50 percent, were euthanized. Those included feral cats and animals with medical and behavior problems. The others were either placed in new homes or returned to their owners.

Fees at the shelter vary and depend on elements such as any medical treatment the animal may have received and whether it needs to be spayed or neutered, according to Schroen.

The Dogs XL Rescue group, a private shelter which specializes in placing larger dogs in new homes, charges $350 for puppies six months and younger; $300 for dogs from six months to seven years of age, and $250 for dogs 7 years and older, according to its website.

Wallace said her organization has been "inundated" with phone calls asking her to ?do something? about Charm City Puppies, which, she said, is not her job.

"I certainly hope no harm comes to him," she said of Cossentino. "But I would hope he would take the time to sit down and talk with someone about a different business model to pursue. He could sell supplies and accessories but not the animals and do just fine."

Mitt Romney may not release tax returns until (Reuters)

MYRTLE BEACH, South Carolina (Reuters) ? Republican presidential candidate Mitt Romney, under increasing pressure to release his tax returns now, continued to resist that timetable on Tuesday and said he probably would not make them public until April.

Romney, the frontrunner for the Republican nomination to face Democratic President Barack Obama on November 6 and a former private equity executive with an estimated net worth of $270 million, has been reluctant to lift a curtain on his vast financial holdings.

In recent days, Romney's increasingly desperate rivals - namely former House of Representatives speaker Newt Gingrich and Texas Governor Rick Perry - repeatedly have questioned whether Romney, in not releasing the tax returns, is hiding something.

Their calls for Romney to release his returns were echoed on Tuesday in a New York Times editorial, which called Romney's "insistence on secrecy impossible to defend now that he appears to be closing in on the nomination and questions have intensified about his personal finances."

During Monday's Republican presidential candidate debate in Myrtle Beach, Romney said, "I have nothing in (the returns) that suggests there's any problem and I'm happy to" release them around the federal tax deadline in mid-April.

"I sort of feel like we are showing a lot of exposure at this point," Romney added. "And if I become our nominee, and what's happened (with past presidential candidates) is people have released them in about April of the coming year, and that's probably what I would do."

FORTUNE INVESTED IN BAIN FUNDS

Tax analysts say Romney, one of the wealthiest presidential candidates in U.S. history, may have good reason to be reluctant to release his returns.

His vast fortune is invested in dozens of funds linked to Bain Capital, the powerhouse private equity firm he led for 15 years. Several Bain funds have offshore connections and take advantage of tax breaks used only by the U.S. financial elite.

His tax returns could shed light on how Romney and Bain use offshore strategies to avoid taxes, said Daniel Berman, a former U.S. Treasury deputy international tax counsel and now director of tax at Boston University's graduate tax program.

Bain funds in which Romney is involved are scattered from Delaware to the Cayman Islands and Bermuda, Ireland and Hong Kong, according to a Reuters analysis of securities filings.

"Certain interests in foreign investment structures would have to be reported on attachments to his return," Berman said.

The wealthiest Americans typically earn a large chunk of their income from investments - much of it in capital gains.

Because capital gains generally are taxed at 15 percent compared with the top ordinary income tax rate of 35 percent, those with significant income from capital gains may pay lower tax rates than many Americans.

On capital gains, Romney's tax returns would not reveal any gains that he has not yet realized, even though those gains would be easy for him to lock in at any time, Berman said.

"I remember as a young lawyer being surprised to see tax returns of very successful investors showing net losses - because they were recognizing net losses - not unrealized gains," Berman said.

Romney's returns also might not spell out how much he benefits from a tax break called the carried interest loophole.

This rule allows private equity and hedge fund managers to pay the 15 percent capital gains tax rate, rather than the top income tax rate, on a large portion of their earnings.

After a campaign event on Tuesday in Florence, South Carolina, Romney told reporters that his tax rate is "probably closer to 15 percent than anything."

Romney also said he gets speaker fees "from time to time, but not very much."

Annual campaign financial disclosure forms indicate that Romney was paid more than $374,000 in speaker fees from February 2010 to February 2011.

A SERIES OF ATTACKS

The demands by Gingrich and Perry are their latest attempt to draw attention to Romney's wealth and portray him as out of touch with the concerns of most Americans.

They also echo Gingrich and Perry's criticism of Romney's time at Bain, which Romney co-founded in 1984 and left in 1999. Bain was involved in overhauling dozens of companies, and in some cases laid off thousands of workers.

Gingrich, Perry and others have portrayed Romney as a job killer and, as Perry put it, a "vulture capitalist."

The attacks don't seem to have worked. Romney is still riding high in public opinion polls of the Republican candidates. And some conservative Republicans accuse Gingrich and Perry essentially of an assault on capitalism.

Gingrich and Perry went after Romney on the tax return issue during Monday's debate, and Gingrich continued to pound on the theme Tuesday.

"It's interesting that Romney agreed that he ought to release his income taxes but he doesn't want to do it until April," by which time Romney could have clinched the Republican nomination, Gingrich said during an interview with CBS.

"I think the people of South Carolina ought to know now -- if there's nothing there, why hide it until April? And if there's something there, don't the people of South Carolina deserve to know before Saturday?"

Gingrich added that he would release his tax returns this week. As Texas governor, Perry has released his each year.

Gingrich and Perry are battling former Pennsylvania U.S. senator Rick Santorum to put together enough conservative votes to block Romney's march to the nomination.

Romney won the Iowa caucuses and New Hampshire primary this month - the first two nomination contests - and is favored to win the South Carolina primary Saturday as well as Florida's primary on January 31.

Santorum, thought earlier this month to be Romney's main challenger, has not been as vocal in calls for Romney to release his tax returns.

A Santorum aide said that he was unsure whether Santorum would press Romney on the matter, but said, "We've been a pretty staunch advocate of airing out all the laundry now."

"We don't need any surprises," the aide said. "We need to know now."

The Romney campaign dismissed the latest calls to release his tax returns as a sign of desperation.

"This is pasta politics," Eric Fehrnstrom, a senior Romney adviser, said. Gingrich is "throwing spaghetti against the wall to see what sticks."

"I've written 10 speeches and after the 10th one, I threw it away, and said 'I can't write a speech,'" Waltrip said. "I'm pretty spontaneous, so I'm just going to get up and say what I think and hope it's the right thing."

Waltrip hasn't always said the right thing in a career that dates back to his 1972 debut in NASCAR's top series. He angered his rivals as a driver, and his strong opinions as an analyst for both Fox Sports and Speed have made him one of the more polarizing commentators in NASCAR.

Some might even think it cost him a shot in last year's voting, when despite three championships and 84 victories, Waltrip was shut out of the second Hall of Fame class. Waltrip had signed on with Speed as an analyst for voting day, and from his perch on the stage at the back of the Great Hall, his face couldn't hide his heartbreak over not making the second class.

He tried not to get his hopes up this time around, but everybody knew how badly Waltrip wanted to be included in the third class. Brian France called his name last June, Waltrip rushed onto the podium and kissed the NASCAR chairman.

Waltrip goes into the Hall of Fame with three-time champion Cale Yarborough, NASCAR modified great Richie Evans, innovative crew chief Dale Inman and Glen Wood, one of NASCAR's original team owners.

The show will belong to Waltrip, though, who knew as a child he wanted to be an entertainer and found a way to incorporate his desire to perform into his NASCAR career. He was brash and bold and loved being in front of the cameras.

His style, his showmanship, was like nothing NASCAR had ever seen before and paved the way for more personality from the drivers.

"I always thought it would be fun to be an actor, or a comedian, but I guess race car driving suited me," he said. "I like to make people laugh, which is better than making them cry, right? Some people take the path of least of resistance, but I take the path I couldn't resist. I looked at everything I did, what if I did everything that everybody else is doing as they go down that path.

I figured there's a lot more room going in this other direction then there is in that direction with all the other guys who chewed Skoal and wore belt buckles and cowboy hats. I'm not making fun of them, I just chose not to go down that route, to be more upscale, in a class by myself. I was a Penske guy living in an Earnhardt world."

He will be again on Friday night when his larger-than-life personality is sure to outshine Yarborough, Inman and Wood. Evans, winner of nine NASCAR national modified championships over a 13-year span, was killed in a 1985 accident at Martinsville Speedway. He was 44.

Yarborough from 1976-78 became the first driver in NASCAR history to win three consecutive championships, a record that stood until Jimmie Johnson's run of five-straight titles. He finished second in the standings another three times, and ended his career with 83 victories ? sixth on the all-time list.

Yarborough was a four-time Daytona 500 winner, but decided in 1980 to run only partial schedules for the final nine years of his career.

"I realized I had three daughters growing up and I was away from them all the time," he said. "Even though racing was very important in my life, I felt like they were a little more important so I was going to spend some more time with them and be with them in their growing-up years. There's no telling how many wins I left on the table, but I definitely made the right decision."

Inman led his cousin, Hall of Famer Richard Petty, to a record seven championships. The crew chief won an eighth title with Terry Labonte. From 1958 to 1992, he led drivers to 193 wins and 129 poles.

His standout year was 1967 when he guided Petty to a NASCAR-record, 27 races ? including 10-straight ? in a single car built a year earlier.

"Dale was a racing benchmark," Petty said. "He was the sport's first official crew chief and people modeled themselves after him. He knew what, when and where ? and when he made a mistake he wasn't afraid to admit it. Everyone respected him for that. Nobody even comes close to the number of wins that Dale has recorded."

Wood, at 86 the oldest member of this incoming class, formed a race team that still competes today in Stuart, Va., with his four brothers. Trevor Bayne won the Daytona 500 last year for the Wood Brothers, giving the team its 98th victory spanning seven different decades. Bayne's win was the team's fifth Daytona 500 victory, and the Wood Brothers also won the 1965 Indianapolis 500 with Jim Clark.

Wood's brother, Leonard, choreographer of the modern pit stop, is a NASCAR Hall of Fame nominee.

"It's such a long trip from 1950 to now. It's sort of hard to believe," Wood said. "It's one of the biggest honors you could have. I didn't come here alone; I had a lot of help. There's five of us brothers. All of those helped at one time or another."

Israel blasts UK's Clegg over settlement comment

LONDON (Reuters) -- An Israeli minister called Britain's Deputy Prime Minister Nick Clegg irresponsible and ill-informed on Tuesday for condemning Israeli settlements as "deliberate vandalism" of efforts to establish a Palestinian state.

Visiting Israeli Deputy Foreign Minister Danny Ayalon said Clegg's comment gave the Palestinians an excuse to set pre-conditions for entering negotiations with Israel on a Middle East peace settlement.

"I think it was unfortunate, I think it was gratuitous, I think it was ill-informed, I think it was somewhat irresponsible," Ayalon said when asked about Clegg's comment during an event at Chatham House, a London thinktank.

Speaking during a visit by President Mahmoud Abbas to London on Monday, Clegg said expanding Jewish settlements was "an act of deliberate vandalism to the basic premise upon which negotiations have taken place for years".

Clegg leads the center-left Liberal Democrats, the junior partner in Britain's Conservative-led coalition.

Ayalon told Reuters in an interview that Clegg's comment was "far from the truth" and gave the Palestinians an excuse to set more pre-conditions for talks that would create obstacles to moving forward with negotiations.

Israelis and PLO officials have begun exploratory talks in Amman, Jordan, on resuming full negotiations on a peace accord.

Abbas suspended talks 15 months ago over Israel's expansion of Jewish settlements in the occupied West Bank, where Palestinians want to found a state.

The Palestinians have previously demanded a halt to Jewish settlement building in the West Bank before holding more talks.

Ayalon said Israel would not halt settlement construction as a condition for resuming full negotiations.

"The settlement issue is but one of many core elements of the conflict. I don't think it is the major one ... All those elements are inter-related and you cannot cherry-pick one and try to solve it irrespective of the others. All these issues should be on the table without pre-conditions," he told Reuters.

Ayalon, in London for talks with the British government, said it was coincidence he was in Britain at the same time as Abbas.

Huntsman is Only GOP Candidate Who Can Actually Beat Obama (ContributorNetwork)

COMMENTARY | When Mitt Romney attacked Jon Huntsman for his service in the Obama administration on Saturday, he had no idea the former Utah governor would get the last word. The Los Angeles Times reported that the allegations continued the next day on a NBC/Facebook roundtable debate. For me, that was proof Huntsman really is the only Republican who can actually win the White House this year.

The former Utah governor served as ambassador to China until April, when he resigned to enter the Republican race to replace his former boss. The fact Huntsman served under a Democrat president isn't something to criticize him about -- to the contrary. It's admirable that he was able to serve our country in a way that found common ground with a politically-opposed president. I would be concerned by any president that couldn't find room for people with opposing ideas.

I've kind of been all over the board about Huntsman. I like the guy. I like his wholesome looks and his "hip" connection to young voters -- he plays rock music. In many ways, he's the best candidate the challenge Obama in the fall, but he just can't seem to get a "moment" in the spotlight with the stage so crowded.

Politico described him as a "formidable entry in the ? GOP field," and a fiscal conservative, with the most foreign policy experience of any GOP candidate. That's exactly what the Republican Party needs. The religious right has driven the party into hard-line issues that alienate the country and are just plain wrong. Huntsman takes a much softer stand on many of those issues -- something that should appeal to Democrats and independents.

He is the child of a billionaire businessman and pretty successful in business in his own right. He knows Wall Street and the halls of diplomacy. He's a "fixer" and had one of the highest popularity rates of any of the nation's governors.

Obama will be hard pressed to criticize a man that served admirably in his own administration. On foreign trade and domestic issues, Huntsman can go toe-to-toe with the sitting president, and he understands the Chinese. In fact, he speaks it too. That's the person we need negotiating the next trade agreement with the largest holder of U.S. debt.

Huntsman is also -- in some respects -- a new kind of Republican. That's what the party needs right now. In fact, that's what the nation needs right now.
