LONDON (AP) ? A Scottish newspaper on Sunday published previously undisclosed files on the 1988 Pan Am bombing that killed hundreds over Lockerbie, arguing it is in the public interest to ignore data protection laws that have kept the documents from the public.

The Sunday Herald newspaper posted an 800-page report by the Scottish Criminal Cases Review Commission to its website. It said it had been authorized to publish the documents by Abdel Baset al-Megrahi, the only man convicted over the bombing that killed 270, mostly Americans, and who has long insisted he did not carry it out.

Scotland's leader Alex Salmond defended their publication, saying it would help better inform the public debate over the case made against al-Megrahi.

Scottish legal authorities have said that though it is an offense to disclose the information, no one would be prosecuted over the decision to publish. Scotland's Lord Advocate Frank Mulholland, the country's most senior legal officer, said he did not consider it in the public interest to prosecute.

Mulholland said the issues around al-Megrahi were "exceptional circumstances" and that justice had not been served "by selective and misleading reporting" of some excerpts of the file, meaning it was welcome that the entire document was made public.

The files offer a more detailed explanation of the decision by the commission ? which investigates potential miscarriages of justice ? to uphold six points of appeal put forward by al-Megrahi ahead of planned appeal hearing in 2009.

However, the document also shows how the commission dismissed many other points raised by the Libyan and offered backing to evidence considered crucial to his 2001 conviction.

Al-Megrahi dropped his plan to pursue an appeal court hearing shortly before he was granted a compassionate release from a Scottish jail in August 2009 and returned to his native Libya, where he is being treated for prostate cancer

"This report provides valuable information, from an independent body acting without fear or favor, and while we can not expect it to resolve all the issues in the Lockerbie case, it does however lay the basis for narrowing the areas of dispute and in many ways is far more comprehensive than any inquiry could ever hope to be," Salmond said following publication of the files.

The files explain that the commission accepted some of al-Megrahi's concerns over evidence that had not been passed to his defense team, including some classified intelligence files.

Al-Megrahi has questioned the testimony of a shopkeeper who identified him as having bought a man's shirt in his store in Malta. Scraps of the garment were later found wrapped around a timing device discovered in the wreckage of the airliner.

In the newly published document, the commission expressed concern that evidence that the shopkeeper had seen a magazine article linking al-Megrahi to the bomb plot was not passed to defense lawyers by the prosecution.

However, the files show the commission rejected dozens of other points made by al-Megrahi and supported forensic evidence that tied the suspect to the store in Malta, and to the bombing.

"While the report shows that there were six grounds on which it believed a miscarriage of justice may have occurred, it also rejected 45 of the 48 grounds submitted by al-Megrahi, and in particular it upheld the forensic basis of the case leading to Malta and to Libyan involvement," said Salmond, head of Scotland's semiautonomous government.

Scotland's Crown Office, the country's prosecuting authority, said that al-Megrahi's decision to abandon his appeal means it cannot be known if a court would have ruled in his favor on any of the outstanding points.

"It does not follow that there was a miscarriage of justice, only the appeal court can decide that," the office said in a statement.

GOODYEAR, Ariz. (AP) ? Instead of closing for the Cincinnati Reds, Ryan Madson will miss the 2012 season because of a torn ligament in his right elbow.

Madson returned to Cincinnati and was examined by team medical director Dr. Timothy Kremchek. The Reds said Saturday that Kremchek told general manager Walt Jocketty the ligament was torn from the bone of Madson's right elbow.

"We talked to the team. We all have to stay positive," Jocketty said. "We have alternatives internally that we will sort through in the next few days."

Madson agreed in January to a one-year contract guaranteeing $8.5 million, after a $44 million, four-year deal to stay with Philadelphia collapsed in November.

The 31-year old reported discomfort in his elbow at the start of spring training but insisted it was an annual ailment that he had always worked through. He didn't pitch in any exhibition games.

Madson pitched batting practice Tuesday and had been scheduled to throw again on Friday.

"He looked very good on Tuesday. He felt some tightness the next day," Jocketty said. "He felt fine all spring until lately. Even after he sat out for a little bit and came back he felt real good. After the live session the other day it felt tight but even when he left the other day, he felt fine."

Dr. Kremchek explained to Jocketty that bleeding made it appear the tear was recent.

Madson's contract calls for a $6 million salary this year, of which $2 million is deferred until Nov. 1 and $2 million until Nov. 1, 2013. The agreement includes a $11 million mutual option for 2013 with a $2.5 million buyout.

Madson saved 32 games in 34 chances last year for the Phillies and was to have replaced Francisco Cordero as the Reds' closer.

Sean Marshall, obtained from the Chicago Cubs in December, becames a leading candidate for closer. Hard-throwing Aroldis Chapman could be shifted to a bullpen role.

"Those are some of the things we'll sort through in the next week or so," Jocketty said.

WASHINGTON (AP) ? A discarded chunk of a Russian rocket is forcing six space station astronauts to seek shelter in escape capsules early Saturday.

NASA spokesman Rob Navias (NAVE-e-us) says the space junk will barely be close enough to be a threat. But if it hits the station it could be dangerous, so the astronauts ? two Americans, three Russians and a Dutchman ? will wake early and climb into two Soyuz vehicles ready to rocket back to Earth just in case.

The debris is supposed to come closest at 2:38 a.m. EDT. It was not noticed until Friday, too late to move the International Space Station out of the way.

This is the third time in 12 years that astronauts have had to seek shelter from space junk.

Twenty years after the fact, people are still talking about Brent Spar, the 14,500-ton North Sea oil platform Shell was all set to dump into the Atlantic Ocean until protests inspired by Greenpeace ignited a citizen fury so intense that according to one poll, the oil industry's public acceptance declined from 70 percent in the 1970s to 32 percent in 1996 post-Brent Spar. The protests hurt sales too: Shell gas stations lost sales, as high as 50 percent in Germany.

Another example: in 2004, Shell took a serious hit to its reputation when it overstated its oil reserves, screwing its shareholders and government allies, and was forced to restructure. New management began addressing its environmental mistakes with gusto. CEO James Smith led the company to invest in renewable energy sources such as plant-based biofuels and offshore wind energy, embodying a caring, environmentally friendly image. (Shell has since pulled out of all alternative energy projects except biofuels.)

Under Smith's watch, Shell also cleaned up its legal messes. In 2009, the company settled legal cases in Niger stemming from the 7,000 oil leaks from pipes installed starting in the 1960s. The pipes had life-spans of only 20 to 25 years. Shell also settled a case charging them with collaborating with the Niger military to kill environmental activists who led the protests.

That same year, Shell settled a case in California over leaks in gas storage tanks at its stations. Shell had "disregarded the state's underground fuel storage and hazardous waste laws," as California Attorney General Jerry Brown stated.

So confident was Shell that it had cleaned up its image that when the BP oil spill happened in April 2010, Shell launched an aggressive campaign to claim the alternative energy positioning once owned by BP/Beyond Petroleum. As reported in Ad Age:

"The effort touts the dawn of a future that will be powered by new and multiple energy sources and cleaner fossil fuels that Shell is 'unlocking.' It also expresses the notion the world will soon be on the road to sustainable mobility and that Shell is 'ready to help tackle the challenges of the new energy future.'"

With this new lawsuit against environmental organizations, Shell believes that it has found a way at last to forestall consumer activism. Really? The Arctic has become a symbol of unspoiled nature. Penguins are stars of live and animated movies. Nature series run specials on the Arctic. Polar bears are beloved.

Greenpeace has already geared up to repeat its success with Brent Spar.

What led Shell on this foolhardy course? Perhaps it is well aware of its vulnerabilities. As noted by Oceana's advisor Whit Sheard, who last month filed a challenge to Shell's exploration plan, "This cleanup plan, just like their previous cleanup plans, is woefully inadequate, based on technology that has never been proven."

The weirdest thing is that Shell is known for its ability to forecast correctly. It was the "only oil company to anticipate both 1973's oil-price boom and 1986's bust." Its scenario-planning group famously predicted the collapse of the Soviet Union and the opening of its oil fields. How can the company continue to be so myopic when it comes to assessing consumer power?

One guess is that its legal department doesn't talk to its brand reputation group. Too bad for Shell. Even the legal profession has its environmental activists and climate justice organizations are on the case. As Jennifer Marlow, co-founder of the Three Degrees Project says,

Shell insulated itself from the oil price shocks in the 70s by planning ahead and outsmarting its competitors. Now, it's applying the same anticipatory tactics to prevent public interest environmental groups from obstructing 'justice' at some point in the future. While future thinking helped Shell gain the market during the oil crisis, the same tactics won't work here.

And even if the Alaskan courts do rule in Shell's favor, it is the court of public opinion that wields the most power, as Shell will have to learn all over again.
